Welcome to the Eequ privacy policy.

INTRODUCTION

Eequ Ltd respects your privacy and is committed to protecting your personal data. This privacy policy will inform you as to how we look after your personal data when you visit our website or use our platform and tell you about your privacy rights and how the law protects you.

Eequ is used by individuals who book learning activities from a variety of activity providers who we call Mentors. Some of these Mentors receive funding for their activities. One of the common sources of funding is via the Holiday and Food Programme (HAF), SEND Short Breaks and other programmes which are funded by local authorities. If you participate in the HAF programme or other council-funded programme, please read the below information about how we work with Councils to ensure your privacy is respected and that your personal data is protected.

Holiday Activities and Food Programme (HAF) and SEND Short Breaks programme

Eequ has partnered with several Councils and event providers as part of the government's HAF and SEND Short Breaks Programme, which aims to deliver activities and healthy meals during the school holidays for children of eligible families.

Our role in the HAF, or other council-funded programmes, is to facilitate families booking onto events in their locality and we process your data on behalf of the councils and event providers taking part.

Therefore, this privacy notice does not apply to data processed for the HAF programme, SEND Short Breaks programme or other council-funded programmes. For further details about the processing of your personal data for council-funded programmes, please see your council’s Data Protection web page.

In order to provide the activities to you and your family it is necessary to collect and hold special categories of personal data about you and your child/ren. This information may include:

· Reason for eligibility to the programme

· Gender

· Medical, health and special educational needs

· Ethnicity

Eequ will collect personal and special category data from providers and families to ensure the smooth running of the council programme. The relevant Council and providers will handle personal data in accordance with UK data protection legislation and other relevant legislation and will not disclose your data to any other third party unless allowed or required to do so by law. Eequ will not retain your council questionnaire data beyond the contract with your council.

Some headlines about Eequ’s use of data:

The information we gather or process is used solely for core functionality of Eequ and to improve the quality and security of our service. Your information isn’t and has never been sold to third parties.

We are curating, on your behalf, a private summary (Portfolio) of learning for each adult or child learner that uses Eequ to book Learning Experiences. This helps adult learners, parents and children keep track of their learning experiences and helps us suggest potential new learning experiences or mentoring which might complement them. This summary, known as The Portfolio, will never be shared with a third party without your express consent.

We will delete your Eequ account on request, but if you are a mentor you will still appear on the learning portfolios of learners who have made bookings for your experiences previously.

1. IMPORTANT INFORMATION AND WHO WE ARE

i) Purpose of this privacy policy

This privacy policy aims to give you information on how Eequ Ltd collects and processes your personal data through your use of this website, including any data you may provide through this website when you register, create a listing for a learning experience, or make a booking for a learning experience. It applies to visitors to our website, customers booking learning experiences (Customers), mentors providing those learning experiences, or their staff (Mentors), and learners booked to attend learning experiences (Learners).

It is important that you read this privacy policy together with any other privacy policy or fair processing policy we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements other notices and privacy policies and is not intended to override them.

Eequ Ltd is the controller and responsible for your personal data (collectively referred to as Eequ, "we", "us" or "our" in this privacy policy).

Our ICO registration number is ZA465055. We have appointed a data protection officer (DPO) who is responsible for overseeing questions in relation to this privacy policy. We keep our privacy policy under regular review. This version was last updated on 6th June 2023. Historic versions can be obtained by contacting us.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

This website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy policy of every website you visit.

vi) Children

We are especially concerned to protect the privacy of child learners. We do not collect any information from Learners, and request authority from their parent/guardian (as Customer) before processing any personal data regarding Learners. We are also required to make reasonable efforts (using available technology) in these circumstances to verify that consent provided on behalf of a Student has, in fact, been provided by the holder of parental responsibility for that child.


2. THE DATA WE COLLECT ABOUT YOU

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  1. Facebook/Google Log In Data will be collected by us if you choose to connect your account on Eequ.

  2. Mentor Identity Data includes [first name, last name, username or similar identifier, date of birth, relation to Student].

  3. Mentor Contact Data includes [home address, learning experience address, email address and telephone numbers].

  4. Customer Identity Data includes [first name, last name, date of birth].

  5. Customer Contact Data includes [home address, email address and telephone numbers].

  6. Learner Identity Data includes [first name, last name, username or similar identifier, date of birth, relation to Customer].

  7. Mentor Financial Data includes Mentors’ bank account and payment card details (we only retain the last four digits and send the complete details directly to Stripe, the payment service provider integrated with Eequ, via an encrypted token.).

  8. Mentor Confidence Data means reviews of mentors by customers, and a rating we derive for Mentors from activity on the Eequ platform.

  9. Transaction Data includes details about payments to and from you in relation to bookings made on Eequ.

  10. Technical Data includes [internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website].

  11. Mentor Profile Data includes [your username and password, purchases or orders made by you, your interests, preferences, feedback on Mentor sessions and survey responses].

  12. Customer Profile Data includes [your username and password, bookings made by you, cancellations of bookings made by you, preferences, feedback and survey responses].

  13. Learner Profile Data includes a profile of Learners’ learning and dietary preferences and requirements, feedback on Mentor sessions, and survey responses, and data derived from analysis of that information by us using analytics tools (including, with your explicit advance consent, psychometric profile data).

  14. Learner’s Learning Portfolio comprises a record of sessions attended by you in relation to bookings on Eequ, and may include documents, images and/ or recordings of you attending Mentors’ learning or leisure experiences.

  15. Usage Data includes information about how you use our platform.

  16. Marketing and Communications Data includes your preferences if you login via Facebook or Google account, we may receive information from them about you, with your express consent. For example, we may receive information like your public profile, email address, friends list and likes. You can stop Facebook or Google sharing the information with us by removing our access to Facebook or Google.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users who engage mentors on a repeat basis, or the ratio of learners who attain a certain level of learning progress in respect of certain types of learning experience. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We may collect Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, information about your health, and special educational needs).

Eequ has partnered with several Councils and providers as part of the government's Holiday Activity Fund (HAF) to deliver activities and healthy meals during the school holidays for children of families eligible for benefit-related free school meals.

In order to provide the activities to you and your family it is necessary to collect and hold special categories of personal data about you and your child/ren. This information may include:

· Reason for eligibility to the programme (Free School Meals - FSM etc.)

· Home Address

· School

· Gender

· Medical, health and special educational needs

· Ethnicity

Eequ will collect personal data from providers and families to ensure the smooth running of the programme. The relevant Council and Eequ will handle personal data in accordance with the UK General Data Protection Regulation / Data Protection Act 2018 and other relevant legislation and will not disclose your data to any other third party, unless allowed or required to do so by legislation. We do not collect any information about criminal convictions and offences.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). An example of this might be in the case of providing Mentors with a Stripe account where identification (Know your customer) and money laundering checks are made. In this case, we may have to cancel any registration you have with us but we will notify you if this is the case at the time.


3. HOW IS YOUR PERSONAL DATA COLLECTED?

We use different methods to collect data from and about you including through:

Direct interactions.

You may give us your Identity, Contact and Mentor Financial Data (given to Stripe, our payment processor) by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

i) Make or accept bookings on Eequ;

ii) Create an account on our website;

iii) Subscribe to our newsletter or promotional updates;

iv) Enter a competition, promotion or survey; or

v) Give us feedback or contact us.

Automated technologies or interactions.

As you interact with our website, we will automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies. We may also receive Technical Data about you if you visit other websites employing our cookies. Our use of data analytics tools.

We analyse Learner Profile Data to derive suggestions and recommendations for potentially suitable Mentor experiences, as well as courses, apprenticeships or other educational opportunities.

Third parties or publicly available sources.

We will receive personal data about you from various third parties and public sources as set out below :

  1. Transaction Data from Stripe, the payment services provider integrated into Eequ.

  2. Data from social networks such as LinkedIn, for the purpose of building a Mentor Confidence Score.

  3. With the consent of the Customer, we receive from the relevant Mentor image and recordings of the Student at the Mentor’s Learning Experience to put in their Student Learning Portfolio.

  4. Transaction data as well as customer and mentor contact data from Intercom our chatbot for the purpose of responding to your queries and developing our information resources. We also use this data to prompt you at various stages in the registration, listing or booking journey.


4. HOW WE USE YOUR PERSONAL DATA

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  1. Where we need to perform the contract we are about to enter into or have entered into with you on the basis of our Mentor or Customer Terms and Conditions.

  2. Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

  3. Where we need to comply with a legal obligation.

Please see the GLOSSARY & LAWFUL BASIS sections to find out more about the types of lawful basis that we will rely on to process your personal data.

If your booking is related to the HAF programme we will collect information about you (where applicable) to:-

• Determine the eligibility of children for the Holiday Activity Fund (HAF).

• Connect parents and providers in high-risk groups to connect to support children so they have a high-quality activity with food over the school holidays.

• Share any medical or personal data (e.g. food allergies, additional needs) to help keep children safe.

• Co-ordinate an effective response to a holiday activity fund (HAF) from the council and the wider community.

• To contact you with service updates relating to the Holiday Activity Fund.

The legal basis (Article 6 of the General Data Protection Regulation) of processing the HAF programme data is in the public interest or in the exercise of official authority.

Generally, we do not rely on consent as a legal basis for processing your personal data although we will get your consent before processing any sensitive personal data. Sensitive data means data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data, biometric data, data concerning health or data concerning a natural person's sex life or sexual orientation. We will also ask for your consent to send third party direct marketing communications to you via email. You have the right to withdraw consent at any time by contacting us.

Purposes for which we will use your personal data

  2. In the future, we will make it possible for you to give your express consent to receive marketing information from Mentors you are interested in.

Opting out

You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by contacting us at any time.

Cookies

You can set your browser to refuse all or some browser cookies or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of this website may become inaccessible or not function properly. Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.


5. DISCLOSURES OF YOUR PERSONAL DATA

We may share your personal data with the parties set out below for the purposes set out in the table (Purposes for which we will use your personal data) above.

  1. If you are a Customer or a Learner, we share your data with Mentors to the extent necessary to facilitate and administer your booking.

  2. If you are a Mentor, we share your data with visitors to the Eequ website so that they can view your listing; we also share your data with Customers and Learners to the extent necessary to facilitate and administer your booking.

  3. Stripe, the payment services processor integrated with Eequ, based in the EU and the USA.

  4. Intercom, based in the USA, who power our chatbot.

  5. Google Analytics, an industry-standard third party analytics platform that we use to understand the usage and performance of our services. The information is anonymised and not tied to your IP address.

  6. Nolt which retains some basic user data for feature requests and bug reporting.

  7. Slack, based in the USA, which we use to convey messages internally at Eequ. User data may be discussed for support purposes.

  8. Gmail is used for internal communications. User data may be discussed for support purposes.

  9. JIRA is used for internal communications. User data may be discussed for support purposes.

  10. Sendgrid, which is used for transactional emails, is based in the USA.

  11. Mailchimp is used to send marketing and some transactional email communications to Mentors and Customers and stores some preferences and other user data relating to frequency of engagement.

  12. Google Drive is used for internal communications. User data may be retained for support purposes.

  13. AWS, who provide cloud servers in the UK for Eequ.

  14. IT Contractors, based in Europe who provide software development services and IT and system administration services.

  15. Council HAF (Holiday and Food Programme) staff who are facilitating any HAF bookings that you make.

  16. In the event that we integrate an insurance provider for Eequ learning experiences, we may provide certain information to them to help set up your account with them.

  17. Professional advisers including lawyers, bankers, auditors and insurers based in who provide consultancy, banking, legal, insurance and accounting services.

  18. HM Revenue & Customs, regulators and other authorities who require reporting of processing activities in certain circumstances.

  19. Any specific third parties listed in the table, Purposes for which we will use your personal data, above.

  20. Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law.

Anonymised data will be shared with the Department for Education for the purpose of submitting the Holiday Activities and Food Programme (HAF) return which is a requirement of the funding received by participating Councils.


6. INTERNATIONAL TRANSFERS

Some of our external third parties are based outside the EEA so their processing of your personal data will involve a transfer of data outside the EEA.

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  1. We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission. For further details, see European Commission: Adequacy of the protection of personal data in non-EU countries.

  2. Where we use certain service providers, we may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe. For further details, see European Commission: Model contracts for the transfer of personal data to third countries.

  3. Where we share data with partners based in the US (such as Stripe and Intercom), we may transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between Europe and the US. 7. DATA SECURITY

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.


8. DATA RETENTION

How long will you use my personal data for?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances, we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.


9. YOUR LEGAL RIGHTS

Under certain circumstances, you have rights under data protection laws in relation to your personal data. Please see the sections below to find out more about these rights:

  1. Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

  2. Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

  3. Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

  4. Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

  5. Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: i) If you want us to establish the data's accuracy.ii) Where our use of the data is unlawful but you do not want us to erase it.iii) Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims. iv) You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

  6. Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

  7. Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide the Eequ service to you. We will advise you if this is the case at the time you withdraw your consent.
